Did you know that, in the UK, you potentially can make a claim directly against an insurer of a company that has gone into liquidation, such that the insurer will have to pay for the liabilities of the liquidated company? This rule is found in the Third Parties (Rights Against Insurers) Act 1930, and a recent UK court of appeals decision has indicated that this Act is to be interpreted broadly to encompass a wide range of liabilities. For example, if you are facing environmental remediation of a site in the UK, with the contamination having been caused by a company that has gone out of business, you may now have the ability to make a claim against the insurers of the insolvent company that operated the site, for funds to support the clean up effort. This interpretation of the Act may provide an important source of revenues.

Larry Eisenstein and John Malanchuk presented a paper at the Contaminated Land conference sponsored by SCI Environment Group and the RSC Water Science Forum on September 12-15, 2004 in England. SCI organized the first UK conference on contaminated land in 1979. This conference was a major international gathering to look back at developments over the past 25 years, and look ahead to the next 25 years. Mr. Eisenstein presented a session at the RIMS 2004 Annual Conference & Exhibition in San Diego on the Top 10 (or 20) Court Decisions in 2003 which impact insurance coverage.

On July 11th 2003, the Wisconsin Supreme Court issued a decision in the Johnson Controls case, overruling its 10-year precedent in Edgerton, and opening the way for environmental coverage claims in Wisconsin. Larry Eisenstein recently made a presentation to the Wisconsin chapter of RIMS about this important new development, focusing on what the Court said, why it is important and potential implications to companies located in Wisconsin or with sites in Wisconsin.
